Entities that provide professional training for employment in the Community of Madrid.
These entities become part of the registry of accredited and/or registered entities and centers, when they are authorized by the regional administration as owners of the training centers for meeting the requirements established in the system regulations.
Register of Vocational Training Entities for Employment
The Register of Vocational Training Entities for Employment of the Community of Madrid, in accordance with the provisions of article 15 of the Law 30/2015, of September 9, which regulates the Vocational Training System for Employment in the workplace, is the Register authorized in the Community of Madrid to register and, where appropriate, accredit both the Training Entities, public and private, as well as the companies that have an accreditation or registration obligation to be able to provide Vocational Training for employment.
All Training Entities that wish to provide Vocational Training for Employment in the Community of Madrid must be accredited and/or registered in the Register of Vocational Training Entities for Employment of the Community of Madrid, as well as in the State Register of Entities Training, as established in article 14 of the Law 30/2015, of September 9, which regulates the Vocational Training System for employment in the workplace.

Accreditation of Entities and Training Centers
They may only be accredited by the General Directorate of Training of the Community of Madrid, the training Entities and the Training Centers concerned, whose spaces, facilities and training resources are located in the territory of the Community of Madrid.
To obtain and maintain the status of Entity and Accredited Training Center, the training Entities that request to provide training leading to obtaining a Certificate of Professionalism in the face-to-face modality must comply, for all the training modules that constitute the Certificate of Professionalism , the requirements established in the royal decrees that regulate them and, in particular, what is established in article 19 of the Order TMS/369/2019, of March 28:
a) Have training spaces, own or owned by third parties in accordance with the provisions of the second paragraph of article 7.2, in which to impart the specialty of certificate of professionalism object of accreditation, equipped with the facilities, equipment and dimensions indicated in the royal regulatory decrees of the corresponding certificate.
b) Without prejudice to what is indicated in the previous section, the training spaces object of accreditation must meet the hygienic, acoustic, habitability, safety conditions and all those that in terms of occupational risk prevention and universal accessibility are required in the legislation. current.
c) Have the minimum area per student required in the regulations governing the Certificates of Professionalism, and a capacity that covers what is indicated in article 4.4 of Royal Decree 694/2017, of July 3.
d) Have management and coordination and secretarial facilities, such as spaces separated from the classrooms, as well as toilets and hygienic-sanitary services for men and women in a number adequate to the training capacity.
e) Have sufficient human resources for programming, administration, management and customer service, as well as commit to having trainers who meet the requirements to teach the specialty certificate of professionalism in accordance with what is stipulated in the royal decrees. regulators of the corresponding certificate of professionalism.
f) Have a training project through which training is planned, scheduled and organized, in accordance with the specifications contained therein in Annex VI of Order TMS 369/2019, of March 28.

The procedure will be initiated at the request of the Training Entity, presented by any of the telematic means included in article 16.4 of the Law 39/2015, of October 1.
The instruction and resolution of the procedure is regulated in article 18 of the Order TMS/369/2019, of March 28.
It will be done exclusively by electronic means. As a consequence of this, administrative notifications will be carried out by electronic means, and the entity requesting accreditation must, at the time of initiating the processing, expressly accept said means of notification through the system provided for this purpose.
The obligations of accredited training entities are those regulated in article 16 of Law 30/2015, of September 9, which regulates the Vocational Training System for Employment in the workplace and those of article 16 of the Order TMS/369/2019, of March 28.
The content of the application and the supporting documentation that must accompany it are set out in article 20 of the Order TMS/369/2019, of March 28, must include at least:
a) Identification data of the training Entity requesting accreditation, in particular name, cadastral reference and notification address.
b) Data identifying the representation or power of attorney that the Training Entity requesting accreditation grants to third parties to act on its behalf electronically before the administration within the framework of the accreditation procedure in the face-to-face mode.
c) Identification data of the legal entity that owns the applicant, in particular NIF/NIE, company name, registered office and website.
d) Identification of the professional certificate training specialties for which accreditation is requested. In the case of training specialties that require recognition by another Administration or body, for the purpose of issuing cards, certifications or professional cards, the supporting documentation of said recognition must be presented. If applicable, proof of payment of the corresponding fee.
e) Means aimed at facilitating universal accessibility, in accordance with the provisions of the consolidated text of the General Law on the rights of persons with disabilities and their social inclusion, approved by Royal Legislative Decree 1/2013, of November 29 , as well as in its implementing regulations.
f) Statement on the accuracy, validity and veracity of the information completed.
g) Consent of the interested party for the treatment of their personal data, as well as information on the rights of access, rectification, deletion, limitation of treatment, portability and opposition to the Registry of treatment activities.

Registration of Entities and Training Centers
Entities and/or interested training centers whose spaces, facilities and training resources are located in the territory of the Community of Madrid may only register in the face-to-face mode. Therefore, the declarations of registration thus formulated will only contain centers, spaces, or facilities located, in this case, in the territory of the Community of Madrid.
For the registration of the Entities and Training Centers, the standardized model of responsible statement called Declaration Responsible for the registration or modification of Training Entities for Employment and Centers, or request for deregistration, in the Register of Vocational Training Entities for Employment, for the delivery, in face-to-face mode, of a training specialty not leading to obtaining Certificate of Professionalism included in the Catalog of Training Specialties.
At the time of presentation, the facilities, equipment, means and human resources specified in the training program must be available for the corresponding specialty in the Catalog of Training Specialties, in addition to complying with the following requirements, as established in the article 24 of the Order TMS/369/2019, of March 28 :
a) Have training centers or spaces, own or owned by third parties in accordance with the provisions of the second paragraph of article 7.2, in which to impart the registered training specialty, equipped with the facilities, equipment and dimensions indicated in the training program associated.

The mere presentation will entail the ex officio registration of said Entity and/or Training Center on the basis of the declaration of responsibility presented in the State Register of Training Entities, without prejudice to the subsequent supervision of compliance with the requirements.

The training Entity that submits the declaration responsible for registration in accordance with the provisions of order TMS/369/2019 of March 28, will be authorized, from the moment of presentation, to start the activity as an Entity and/or Center training courses registered to teach, in face-to-face mode, the training specialties not aimed at obtaining Certificates of Professionalism that are included in the Catalog of Training Specialties.
The registration made through the presentation of the responsible declaration will be subject to the maintenance of the conditions and requirements that motivated its obtaining.
The obligations of the registered training Entities are those that are regulated in article 16 of Law 30/2015, of September 9, which regulates the Vocational Training System for employment in the workplace and those of article 16 of Order TMS/369/2019, of March 28.
The declaration responsible for registration may be submitted by the interested parties or by any person with capacity to act who has been authorized by them to act on their behalf. The representation must be accredited with documents, providing, together with the responsible declaration, the document that proves the powers of representation on behalf of the Training Entity that makes the registration, understanding that the representation made in the corresponding electronic register of powers of attorney is accredited.
The lack or insufficient accreditation of the representation will not prevent the declaration of responsibility from being considered presented, provided that, within a period of ten days, it is provided or the defect is corrected, as established in article 5 of Law 39/2015, from October 1.
The responsible declaration will be presented through the standardized model called “Declaration Responsible for the registration or modification of Employment Training Entities and centers, or request for deregistration, in the Register of Vocational Training Entities for Employment, for the delivery, in face-to-face mode, of a training specialty not leading to the Obtaining a certificate of professionalism included in the Catalog of Training Specialties”.

Accreditation of training entities
In order to obtain accreditation, training entities that request to provide training leading to obtaining a certificate of professionalism, must comply with the provisions of article 21 of the Order TMS/369/2019, of March 28.
The procedure will start at the request of the training entity, presented by any of the telematic means included in article 16.4 of the Law 39/2015, of October 1.
The instruction and resolution of the procedure is regulated in article 18 of the Order TMS/369/2019, of March 28.
Obligations of accredited training entities are those regulated in article 16 of the Order TMS/369/2019, of March 28.

APPLICATION

The request for accreditation is made through the computer application of the State Public Employment Service. Once processed, the Electronic Registry will automatically issue an electronically signed receipt, which will specify the date and time of presentation, an entry number in the registry and, where appropriate, the maximum period established by the regulations for the resolution and notification of this procedure. , as well as the effects that administrative silence may produce. The resolutions and administrative acts that affect their rights and interests will be notified by electronic means to the interested parties in the place that they have indicated for that purpose, in accordance with the provisions of the Law 39/2015, of October 1.
ACCREDITING DOCUMENTATION

The training project of each specialty that is requested, must adapt to what is regulated in Annex VI of the Order TMS/369/2019, of March 28.
The student's guide and the tutor's guide, for each specialty requested, must meet the requirements set out in Annex III of the Order TMS/369/2019, of March 28.
For each face-to-face sessions center that is incorporated, the document that certifies its use must be presented, according to the model “Agreement or Convention signed with each center”, for the specialty requested.
Registration of training entities
The entity that submits a responsible declaration to register in the Register of Vocational Training Entities for Employment of the Community of Madrid, in order to be able to provide tele-training, of a training specialty that does not lead to a certificate of professionalism and that is included in the Catalog of Training Specialties State Public Employment Service regulated by Order TMS/283/2019, of March 12, must meet the requirements established in the training program of the same and also those that are regulated in article 24.2 of the Order TMS/369/2019, of March 28.
Registration in the Register of training entities to teach specialties not leading to a certificate of professionalism is carried out by means of a responsible declaration.
The training entities must present a declaration of responsibility for each of the training specialties that they want to teach.
The training entity that submits the declaration responsible for registration will be authorized, from the moment of presentation, to start the activity as a registered training entity.
If the registration, made through the responsible declaration, does not meet the required requirements, or if the entity that registered does not make the requested documentation available to the Administration, the interested party will be required in the terms established in article 24.3 of the Order TMS/369/2019, of March 28.
The registration made through the presentation of the responsible declaration will be subject to the maintenance of the conditions and requirements that motivated its obtaining and to the fulfillment of the obligations set forth in article 16 of the Order TMS/369/2019, of March 28.

The entities and training centers that are beneficiaries of the subsidies for the financing of the delivery of training actions may request an advance of the amount granted:
- Prior to the start of the training activity, up to a maximum of 25% of the amount granted. Prior to payment, they must present a joint guarantee. Once the start of each training action has been accredited and before its completion, the payment of up to an additional 35% of the amount granted, without the need for a guarantee, provided that the advance payment of 25% referred to in the previous one has been requested and granted. point.

Contracts for alternating training
From March 30, 2022, a new training contract may be formalized called an alternating training contract, regulated in article 11.2 of the Workers' Statute.
The objective of this contractual modality is to favor the labor insertion and training of young people, in a system of alternating paid work activity in a company with training processes in the field of professional training, university studies or the catalog of specialties training courses of the National Employment System and includes benefits for both the worker and the company.
