Competences

The Technical General Secretariat, under the direct dependence of the head of the ministry, will exercise, in general, the powers referred to in article 46 of Law 1/1983, of December 13, and other regional regulations and, in its case, state, that were applicable in the scope defined in article 5 of Decree 38/2023, of June 23, and, in particular, the following:
a) The coordination and submission to the Governing Council of the draft general provisions and agreements that must be approved by it.
b) The study and coordination of the processing of the projects of normative dispositions, as well as the report of said general dispositions.
c) The coordination of the processing of draft orders and agreements, as well as their registration.
d) The processing and preparation of proposals for the resolution of administrative appeals that must be resolved by the Director or Vice-Directors, and of claims for financial liability.
e) The final evaluation, before submitting them to the decision-making body, of the administrative resolutions to be adopted by the head of the ministry.
f) The exercise of the functions of the protectorate of foundations.
g) The coordination and establishment of criteria related to the standardization and adaptation of procedures, without prejudice to the functions attributed to the competent general management in the matter.
h) The management of the issuance of the academic titles corresponding to non-university education and the registration of such titles, as well as the procedures prior to the legalization by the corresponding ministry of the titles and other documents that must take effect abroad.
i) The management of the records of educational centers and the census of associations, federations and confederations of parents of students, as well as federations and confederations of student associations.
j) The management of civil servants and labor personnel of the department, with the exception of teaching personnel and non-teaching civil servants assigned to educational centers, without prejudice to the competences of the department with competences in matters of human resources and function. public.
k) The management and processing of payrolls, social security and mutual benefits of the official and labor personnel of the department, with the exception of teaching staff and labor personnel and non-teaching civil servants assigned to educational centers, without prejudice to the powers of the Ministry. l) The analysis, evaluation and processing of the proposals for the rationalization of the organic and functional structure, as well as the proposal for the elaboration and modification of the list of jobs and budget template.
m) The preparation and processing of the annual draft budget.
n) The follow-up of the execution of the budget credits and the processing of their modifications and other operations on the budgets.
ñ) The monitoring of budgetary and extra-budgetary income.
o) The coordination and control of the execution and approval of the expense and of the closing operations of the fiscal year.
p) Monitoring and control of fixed cash advances and expenses to justify.
q) The administration and patrimonial management of the assets that are assigned to the council, as well as the preparation and maintenance of the inventory of said assets, the conservation of the administrative headquarters and any other competences that correspond to the council under the regulations of heritage, without prejudice to the functions in heritage matters assigned by this decree to the General Directorate of Infrastructures and Services.
r) The internal regime in the field of administrative headquarters, the authorization of material, except for materials purchased by each unit in accordance with its budgetary program, and general services.
s) The direction of the services of attention and information to the citizen, the registry and the management of the system of suggestions and complaints, without prejudice to the functions that the general directorate competent in matter of attention to the citizen has attributed.
t) The coordination of the editorial program and the management of the editorial fund, as well as the production of publications of the Technical General Secretariat.
u) The management of the web portals in the field of the ministry, as well as the execution of the functions that may correspond to it in its field of action in matters of electronic administration and transparency, without prejudice to the powers attributed to the competent general directorates. in matters of electronic administration and transparency.
v) The processing of public procurement files whose competence is not expressly attributed to the General Directorate of Infrastructures and Services, as well as the processing of any incidents arising from the management and execution of contracts.
x) Support in the coordination and promotion of the protection of personal data in the management centers and in the institutional administration.
y) Any others conferred by current legislation that are necessary for the exercise of the powers of the Ministry and that are not attributed to other management centers of the same.
