What is the LMA?
The purpose of the LMA is to guarantee the free circulation and establishment of economic operators in the territory of the Community of Madrid, eliminating unjustified obstacles.
This objective is essential in a context of economic crisis. Companies need a framework of legal certainty and regulatory flexibility to overcome uncertainty and adapt quickly and easily to the drastic changes in demand.
The Open Market Law effectively contributes to reducing unnecessary obstacles and regulations, through the automatic recognition of licenses so that companies and professionals from all over the national territory can operate in this region.
What does it mean for operators?
From the moment in which an economic operator is legally established in a place in Spanish territory, he may carry out his economic activity in the Community of Madrid, through a physical establishment or without it, provided that he meets the requirements for access and exercise of the activity of the place of origin, even when the economic activity is not subject to any requirement in said place.
Any product legally produced under the regulations of a place in Spanish territory may freely circulate and be offered in the Community of Madrid from the moment it is placed on the market.
Are there exceptions to free movement?
Only in the cases of authorizations, responsible declarations and communications linked to a specific facility or physical infrastructure or administrative acts related to the occupation of a certain public domain or when there are reasons of public order, public security or civil protection, duly motivated in a legal or regulatory provision.
What does the LMA imply for the Community of Madrid?
The obligation to review the requirements established in its regulations so that, in the case of demanding more requirements for access to the activity than in other Autonomous Communities, suppress them whenever possible.
