* Decree 229/2023, of September 6, of the Government Council, which establishes the organic structure of the Ministry of the Presidency, Justice and Local Administration (BOCM nº 213, of September 7)

1. The Technical General Secretariat, which depends directly on the head of the Ministry, will exercise, in general, the functions referred to in article 46 of Law 1/1983, of December 13, and other applicable regulations and, in in particular, the following:
a) The intra-administrative coordination of all bodies, organizations, entities and other entities assigned as the Institutional Administration of the Ministry.
b) Advice, legal and technical assistance to the head of the Department and to the different bodies, organizations, entities and entities assigned to it, without prejudice to the powers conferred on the General Counsel of the Community of Madrid and other bodies.
c) The study, coordination and elevation of the matters that are going to be submitted to the Governing Council or its commissions.
d) Coordination for the preparation of the Ministry's proposals to be included in the Regulatory Plan.
e) The study, promotion and coordination of the processing of draft regulatory provisions on matters specific to the Ministry, as well as their preparation, when appropriate, and the report of the regulatory projects on their adaptation to legality.
f) The analysis of the draft laws and draft regulatory provisions prepared by the other Ministries in the terms established in the regulations governing the procedure for the preparation of general regulatory provisions.
g) The coordination and processing of the regulations governing the subsidies granted by the Ministry, as well as the corresponding calls, without prejudice to the powers attributed to the promoting management centers.
h) The processing and preparation of proposals for resolution of administrative appeals that must be resolved by the head of the Department, and of claims of patrimonial liability in matters within the jurisdiction of the Department, provided that in both cases it is not attributed to other organs.
i) The final evaluation of the administrative resolutions of the head of the Ministry before their adoption and, where appropriate, their formalization.
j) The analysis, assessment and processing of the proposals for rationalization of the organic and functional structure of the Ministry, as well as the proposal for the preparation and modification of the list of jobs and the budget template.
k) The organization, management, resolution and control of matters related to the personnel regime assigned to the Ministry, without prejudice to the powers attributed to other bodies in the matter.
l) The preparation of the proposal for the preliminary draft budget of the Ministry and the general organization and monitoring of the budget execution process, both of expenses and income, and the processing of expense files.
m) The processing of contracting files.
n) The report, processing, coordination and monitoring of the conventional activity in the area of competence of the Ministry.
ñ) The processing of files regarding forced expropriation, within the scope of the Ministry's powers.
o) The standardization and rationalization of the Department's work procedures and processes, without prejudice to the powers attributed to other bodies.
p) The inventory and administration of the assets assigned to the Department.
q) The organization and management of general services and the internal regime relating to the headquarters where units of the Ministry are located, as well as the authorization of material, except for materials acquired by each unit in accordance with its budget program, and the coordination and management of occupational risk prevention measures at said headquarters, without prejudice to the powers attributed to other bodies.
r) The organization and management of records and citizen care and information services within the Ministry, as well as the management of the suggestions and complaints system within the Ministry, without prejudice to the powers of the General Directorate responsible for citizen services.
s) The creation, organization and management of the central archives of the Ministry, as well as the management of its documentary funds and the coordination of the organization and completion of administrative files, their archiving and custody.
t) The exercise of functions in matters of citizen participation, good governance, transparency of public activity and monitoring of compliance with active advertising obligations within the Ministry, as well as the coordination of resolutions on the right of access also within the Ministry, all without prejudice to the powers attributed to the General Directorate responsible for transparency.
u) The coordination of the editorial program of the Ministry and the management of its editorial fund, as well as the production of publications of the Technical General Secretariat.
v) The coordination and prioritization of the IT needs of the Ministry, the planning and coordination of actions for their satisfaction and the support and advice to the different bodies of the Ministry, without prejudice to the powers attributed to the Agency for the Digital Administration of the Community of Madrid.
w) The coordination and promotion of the protection of personal data in all the management centers of the Ministry and the direction, coordination and management of the processing of personal data of the General Technical Secretariat, as well as the determination of the purposes and technical means and organizational measures necessary to guarantee compliance with current regulations on the protection of personal data.
x) The exercise of the functions of the protectorate of the foundations attached to the Ministry.
y) Any other functions that are necessary for the exercise of the powers of the Ministry and that are not attributed to other units or management centers of the same, as well as the powers that are expressly delegated or attributed to it.
2. The following powers specifically correspond to the Technical General Secretariat of the Ministry of the Presidency, Justice and Local Administration:
a) Assistance to the Vice-Ministry of the Presidency in channeling institutional relations of the Community of Madrid not residing in other management centers.
b) The coordination and promotion, under the superior authority of the Minister of the Presidency, Justice and Local Administration, the Secretary General of the Government Council and the Vice-Minister of the Presidency and Local Administration, of the Government's legislative program, analyzing the different legislative proposals of the Ministries and preparing draft laws and other general provisions of the Ministry.
c) The Registry of agreements and Protocols, in which the general agreements and protocols of action or similar instruments that involve mere declarations of intent entered into by the Administration of the Community of Madrid, as well as autonomous bodies, public law entities, are deposited. and other entities of the institutional administration whose legal nature is public law, in accordance with the provisions of the regulations governing conventional activity of the Community of Madrid.
d) The registration of the Medals of the Community of Madrid awarded, in accordance with the provisions of article 4 of Law 3/1985, of March 22, on the Medal of the Community of Madrid.
e) Prior authorization for the contracting of advertising, promotion, dissemination and announcements in any media, except in official newspapers, by the different units of the Administration of the Community of Madrid, autonomous organizations, public companies and the rest of public entities, with the exception of the public company Radio Televisión Madrid, SA, and the receipt of prior communication of the contracting of advertising, promotion, dissemination and announcements, except in official newspapers, by the companies in whose share capital significantly, directly or indirectly, the Community of Madrid.
f) The powers relating to the organization of electoral processes provided for in Decree 17/1987, of April 9, which regulates the material conditions and other aspects necessary for the holding of Elections to the Madrid Assembly.
g) Coordination regarding the protection of personal data, in accordance with its regulatory regulations, without prejudice to the powers of each Department.
3. In terms of coordination and regulatory quality, the following powers correspond to it, which will be exercised through the Regulatory Quality Office:
a) The issuance of the regulatory coordination and quality report provided for in the procedure for preparing general regulatory provisions.
b) Coordination and preparation of the draft regulatory plan, approving the models that contain information on each regulatory initiative for inclusion in the plan and evaluating the proposals for its modification.
c) The preparation of the draft normative technique and good regulation manual for the Community of Madrid.
d) The adoption of guidelines and instructions for improving regulation.
e) The drive to update and review the regulations.
f) Collaboration with the Ministries in the function of ex post evaluation of the standards.
