The Technical General Secretariat, under the superior direction of the head of the department, will exercise, in general, the powers referred to in article 46 of Law 1/1983, of December 13, and other regional regulations and, in its case, state, that were applicable and, in particular, the following:
1. Regarding the legal regime:
a) Technical-legal advice to the head of the ministry on matters submitted to its opinion, as well as advice to the different bodies of the ministry in the administrative procedures that these bodies promote and whose knowledge is the responsibility of the Technical General Secretariat , without prejudice to the powers attributed to the General Attorney's Office of the Community of Madrid.
b) The study, coordination and elevation of matters that will be submitted to the Governing Council and its commissions.
c) The study, coordination and processing of draft laws and draft general provisions on matters specific to the ministry, without prejudice to the powers that correspond to the general directorates as promoter management centres.
d) The study and analysis, in collaboration with the competent management centers, of the preliminary bills and draft regulatory provisions prepared by the State or other ministries, and the issuance of their mandatory reports.
e) The coordination and processing, without prejudice to the powers of the general directorates as promoter management centres, of the calls, bases and regulatory rules of the subsidies granted by the ministry in matters within its competence.
f) The management of procedures derived from the protectorate of foundations whose purposes are related to the powers attributed to the Ministry.
2. Regarding procedures and administrative actions:
a) The processing of agreements and protocols or declarations of intent that, within the jurisdiction of the ministry, the management centers promote through the corresponding administrative procedure, as well as the archiving and custody of the original copies of the administrative agreements that are established. subscribe.
b) The preparation and processing of proposed resolutions of administrative appeals filed against provisions and acts of the counseling bodies, claims of patrimonial liability and ex officio review procedures, as well as the transfer of decisions of the jurisdictional bodies to the bodies, agencies and entities of the ministry in order to comply with the sentences and other judicial decisions that correspond to them.
c) The issuance of certificates of acts of specific competence of the head of the ministry that has not been delegated, without prejudice to the powers attributed to the management centers, agencies and entities dependent on it with respect to their own acts.
d) The management of the Ministry's publications in official gazettes.
e) The investigation of sanctioning procedures carried out in application of Law 2/2016, of March 29, on Identity and gender expression and social equality and non-discrimination of the Community of Madrid, and Law 3/2016, of 22 July, Comprehensive Protection against LGT Biphobia and discrimination based on sexual orientation and identity of the Community of Madrid.
3. Regarding economic management:
a) The elaboration and processing of the proposal of the preliminary draft of the budget of expenses and income of the council, the coordination of the elaboration of the budgets of the autonomous organisms and their consolidation with those of the council, the analysis and processing of the budget modifications , budget monitoring and control of subsidies granted by the Ministry when appropriate, monitoring of the execution of the budget of expenses and income, without prejudice to the powers that the Ministry's management centers have over the execution of each budgetary program, the processing of the department's expense files within the scope of the powers of the Technical General Secretariat and the coordination and control of the year-end operations.
b) The preparation of the annual account of the department, as well as the coordination of the allegations to the draft annual audit of the Chamber of Accounts, without prejudice to the powers that correspond to the General Intervention.
c) Coordination, monitoring and control of fixed cash advances and payments to justify and extra-budgetary accounts of the Ministry.
d) The processing of files for the execution of final judgments in matters pertaining to the Technical General Secretariat and coordination of the rest of the files in matters pertaining to each general directorate.
4. Regarding contracting:
The processing of contracting files of the department, without prejudice to the powers that correspond to the general directorates as promoter management centers, as well as the management of any incidents and claims that are related to said processing.
5. Regarding internal regime and organization:
a) The coordination of the department's property policy, updating the inventory and administration of the assets affected by it, as well as the organization and management of the internal regime and general affairs.
b) The coordination and management of the records and information services of the department, the coordination of the activities that make up citizen service and the management of the suggestions and complaints system, without prejudice to the specialized records of other units and the powers attributed to other bodies, as well as specific training for public employees, without prejudice to the powers that correspond to the General Directorate of Public Function; the preparation of statistics and the organization and management of the department's editorial and documentary collection.
c) The study and prioritization of the needs in terms of information and communication systems of the department and the planning and coordination of actions for their satisfaction, without prejudice to the powers attributed to the Agency for Digital Administration of the Community of Madrid.
d) The normalization and rationalization of the procedures and work processes of the department.
e) Coordination of the insertion of content and dissemination of information on the subject matter of the department on the website of the Community of Madrid and, where appropriate, on the department's web portals.
f) The coordination and monitoring of advertising, promotion, dissemination and announcements in other media carried out by the management centers of the ministry, as well as the organizations and other public entities assigned to it.
g) The coordination of the functions attributed to the ministry in matters of transparency of public activity, as well as the supervision of compliance with the obligations of active advertising in the terms provided for in the current regulations on transparency, without prejudice to the powers that correspond to the competent body in matters of transparency.
6. Regarding personnel management:
a) The analysis, evaluation and processing of the proposals for rationalization of the organic and functional structure of the department, as well as the proposal for the elaboration and modification of the list of jobs and budget template and its modifications.
b) The planning, control, management and resolution of matters related to the personnel regime dependent on the department.
7. Regarding data processing:
a) The coordination and promotion of the protection of personal data in all the management centers of the department.
b) The management, coordination and direction of said processing of personal data and the determination of the purposes and technical and organizational means necessary to guarantee compliance with data protection regulations.
8. Regarding expenses co-financed by the European Union:
The verification, with respect to all the expenses certified by the management centers of the ministry to the European Commission, of compliance with regional, national and community regulations, as well as that they incorporate both financial and administrative aspects, with verification of the indicators of execution and results that must be met and that the corresponding risk analysis has been incorporated to prevent irregularities and fraud, without prejudice to the powers of other management centers.
