Assistance to Local Entities (cloned)

The purpose of the assistance is the guarantee of the exercise of public functions reserved to local administration officials with national authorization provided for in article 2 of Royal Decree 128/2018, of March 16, in local entities of the territorial scope of the Community of Madrid, with a population of less than 20.000 inhabitants.

It will be provided by authorized officials attached to the competent department in matters of Local Administration, corresponding to the local entities to make available to the local administration official with national qualification the material means necessary for the performance of their functions.

This assistance will guarantee, in any case, the resolution of matters that, due to their nature and their urgent nature, require an immediate response for the ordinary functioning of the local entity.

Legal assistance consists of the provision of advice through the resolution of oral queries, issuance of reports, preparation of forms and file models on issues of interest to local entities.

The reports will be issued in terms of advice, establishing a legal framework that serves as a reference for decision-making, they will be optional, non-binding and in no case will they have the purpose of resolving conflicts or discrepancies of a political nature that arise within of the municipal corporation.

Legal assistance consists of the defense of local entities that request it in legal proceedings with individuals or private entities.

Legal assistance will be provided by lawyers attached to the competent council in matters of Local Administration. Exceptionally, legal assistance may be provided by professionals from outside the Community of Madrid, when the needs of the service so advise, or in matters of special technical difficulty.

Assistance will be provided with the following exceptions:

a) In the case of challenges to municipal acts or agreements by corporate members who have voted against, under the provisions of article 63.1.b) of Law 7/1985, of April 2.

b) In the case of challenging municipal acts or agreements by the State Administration or the Community of Madrid, under the provisions of articles 63.1.a) and 65 of Law 7/1985, of 2 April

c) In the case of the exercise of legal actions of any kind against the State Administration, against the Community of Madrid or its dependent entities or bodies, or against other local entities of the Community of Madrid.

d) In general, all those issues aimed at resolving conflicts or discrepancies that arise within the municipal corporation.

e) The processes of the social or criminal jurisdictions in which authorities or municipal public employees are part, derived from actions that have not been assumed by the corporate Plenary Sessions.

Technical assistance consists of the provision of advice, support and substitution in matters that are directly related to municipal powers, through the resolution of oral consultations, issuance of reports, preparation of forms and file models on issues of interest to local entities.

The municipal powers that will be addressed will be those related to urban planning licences, responsible declarations, road infrastructures and civil works, networks of municipal facilities, drafting of technical specifications and in the definition of the parameters of valuation of works tenders and supervision of projects; and in the management of the different lines of subsidies destined to the local entities of the Community of Madrid, developed by the competent general direction in matters of local regime.

IMPORTANT: Work is currently underway to incorporate Architects and Engineers into this service in order to provide assistance by issuing technical reports that imply the exercise of authority and must be issued by officials. It is recommended to consult assistance before your request.

Economic, budgetary and accounting assistance consists of providing advice on issues that are directly related to municipal powers in matters related to local finance, especially those related to economic, financial, budgetary, accounting and treasury management, through the resolution of oral consultations, issuance of reports, preparation of forms and file models on issues of interest to local entities.

The reports will be issued in terms of advice, establishing a legal framework that serves as a reference for decision-making, they will be optional, non-binding and in no case will they have the purpose of resolving conflicts or discrepancies of a political nature that arise within of the municipal corporation.

For the provision of economic, budgetary and accounting assistance through verbal consultations, it will not be necessary to comply with the formal application requirements of the following section. They can be done on the following phones: 912767626 - 912767643 - 912767646.
