What should I know before starting legal proceedings?
Mediation
Mediation is a voluntary method of conflict resolution that, through the intervention of a neutral and impartial "third party" - the mediator - helps two or more people find solutions to resolve their differences.
The mediator is a professional trained in mediation, who will meet the legal requirements established to play that role.
Mediation can be used in family, criminal, civil, commercial, labor and contentious-administrative matters and at any time during the process, from the beginning to its completion and even in the execution phase.
If agreements are reached, prior to their legal control by the lawyers of the parties, they may be taken to the procedure to be homologated or judicially approved. The judicially approved agreement has the same validity as a sentence.

Which professionals should I contact?
Lawyers or attorneys
The lawyers or attorneys are those professionals in charge of the defense and direction of the parties in judicial and administrative proceedings, also assuming extensive legal advisory and advice work in the extrajudicial field to avoid conflicts.
Their intervention in the Justice Administration, acting before the Courts and Tribunals, is essential for the correct development of the procedures by advising the citizens and interveners on the different procedural procedures, thus guaranteeing their right to defense and legal assistance that is enshrined in article 24 of the Constitution.
In Spain, lawyers must be licensed in Law and be registered in the corresponding Professional Association.

They are those professionals, in charge of the technical representation of the parties before the Courts and Tribunals in the different judicial procedures. In this sense, they are qualified interlocutors between the citizens and the Judicial Bodies, their intervention being justified by the complexity and technical nature of their operation. For this reason, even in those judicial proceedings in which their intervention is not mandatory, the interested parties may appoint an attorney to represent them.
In Spain, attorneys must be law graduates and be registered with the corresponding Professional Association.

A social graduate is a legal adviser in socio-labor matters, an expert in labor relations and human resources. Together with lawyers and solicitors, he is one of the professionals who can intervene before judicial bodies, although exclusively from the social jurisdiction.
