Insertion companies

Are considered Insertion Companies commercial companies or legally constituted cooperatives that carry out any economic activity of production of goods and services, whose corporate purpose is aimed at the integration and socio-labour training of people in a situation of social exclusion as a transition to ordinary employment, and must be qualified by the regional bodies competent in the matter.

They can work in an Insertion Company:

• Recipients of Minimum Insertion Income, or any other benefit of the same or similar nature, according to the denomination adopted in each Autonomous Community, as well as the members of the cohabitation unit who benefit from them.
• People who cannot access the benefits referred to in the previous paragraph, for any of the following reasons:
  • Lack of the required period of residence or registration, or for the constitution of the Receiving Unit.
  • Having exhausted the maximum legally established collection period.
• Young people over eighteen and under thirty, from Institutions for the Protection of Minors.
• People with drug addiction problems or other addictive disorders who are in the process of rehabilitation or social reintegration.
• Inmates of penitentiary centers whose penitentiary situation allows them to access a job and whose employment relationship is not included in the scope of application of the special employment relationship regulated in article 1 of Royal Decree 782/2001, of July 6, as well as released parolees and ex-inmates.
• Internal minors included in the scope of application of Organic Law 5/2000, of January 12, regulating the criminal responsibility of minors, whose situation allows them to access employment and whose employment relationship is not included in the scope of application of the special employment relationship referred to in article 53.4 of the Regulation of the aforementioned Law, approved by Royal Decree 1774/2004, of July 30, as well as those who are in a situation of probation and former inmates.
• People from alternative accommodation centers authorized by the Autonomous Communities and the cities of Ceuta and Melilla.
• People from prevention and social insertion services authorized by the Autonomous Communities and the cities of Ceuta and Melilla.

To obtain the Provisional Rating As an insertion company, they must prove compliance with the qualification requirements established in the following sections:

1. Be registered in the Registry corresponding to its legal form, as well as in the Administrative Registry of Insertion Companies of the Autonomous Community, which in the case of the Community of Madrid is the Registry of Companies for the Promotion and Labor Insertion of People in a Situation of Social Exclusion eligible for subsidies by the Community of Madrid.

2. Not carry out economic activities other than those of its corporate purpose.
3. Have the necessary means to fulfill the commitments derived from the social and labor insertion itineraries.

To achieve the Definitive grade, compliance with the requirements listed below must be accredited within a period not exceeding one year from the provisional qualification:

1. Apply at least eighty percent of the available results or surpluses obtained in each year to the improvement or expansion of its productive and insertion structures.
2. Annually present a Social Balance of the company's activity that includes the economic and social report, the degree of insertion in the ordinary labor market and the composition of the workforce, information on the insertion tasks carried out and the forecasts for the next financial year .

Once the final qualification has been obtained, they will be registered, ex officio, in the Administrative Registry of Insertion Companies of the Community of Madrid.

Failure to comply with the requirements for qualification will lead to the disqualification of the insertion company and its removal from the Administrative Registry of Insertion Companies of the Community of Madrid.

1.- Develop the Itinerary for Social and Labor Insertion and Intervention and Accompaniment Services

The insertion companies must provide workers from the disadvantaged groups mentioned on the home page, as part of their itineraries, personalized and assisted processes of paid work, training in the workplace, work and social habituation.

These companies must have intervention or support services for socio-labour insertion that facilitate their subsequent incorporation into the ordinary labor market.

Failure to comply with the requirements for qualification will lead to the disqualification of the insertion company and its removal from the Administrative Registry of Insertion Companies of the Community of Madrid.

2.- Register them

The insertion companies, once registered in the Administrative Registry of Insertion Companies of the Community of Madrid, will be obliged to present the following documentation:

1. The plan of activities and the budget for each year prior to the beginning of the same.

2. The annual accounts, the management report and the social balance corresponding to the closing of each financial year, without prejudice to the obligations to deposit the accounts and the management report in the Registries that correspond to their legal form.
