
Transnational displacements
They must be communicated to the Labor Authority before the start of the displacement of the workers.
What is meant by displacement?
This is understood to mean that temporarily carried out by companies established in a Member State of the European Union or the European Economic Area to work centers in the Community of Madrid, in the following cases:
- The posting of a worker under the direction of his company in execution of a contract concluded between it and the recipient of the provision of services established in Spain
- The displacement of a worker to a work center of the same company or of its business group
- Posting of a worker by a temporary employment agency to a user company established in Spain.
In what cases should communication be made?
Provided that the posting lasts more than eight days, or even if it lasts less, the posting is carried out by a Temporary Employment Agency (ETT)
Who has the obligation to make the communication?
Employers who relocate their workers to work centers in the Community of Madrid.
What term is there to make the communication?
Always prior to the start of the posting of workers.
