Rights of users of the towing service. Claims and tips for hiring.

It depends on whether the tow truck service was taken care of by your car insurance. In that case, service providers they are not required to give you an invoice.

When this is not the case, they must issue and deliver an invoice or supporting document for the service provided, which includes, among others, the identification data of both parties, the brand, model and license plate of the transported vehicle, the total amount to be paid, with a description of the operations carried out and the consumer's signature. 

My car broke down on the highway and I called a tow truck through my insurance. Do they have to give me any document to show it to the insurance?

It depends on whether the tow truck service was taken care of by your car insurance. In that case, the service providers are not obliged to give you an invoice.

When requesting the service of a tow truck charged to insurance, you must be given a service order in which the following information must be stated:
 
Name and surnames or business name, address and NIF of the owner of the activity.
Industrial registration number, crane registration number, transport authorization number and validity period.
Insurance company name and address, and insurance policy number.
Name and address of the consumer.
Make, model and license plate of the vehicle being transported.
Date and time of the start of the provision of the service, and the scheduled for its completion.
Description of the service, surcharges applied (if any), the number of kilometers of the journey, starting point and destination of the same.
Signature and DNI or passport and/or stamp of the service provider.
Date, signature and DNI or passport of the consumer.

I have called a tow truck and they have given me an information sheet. Does the service provider have to sign it?

In no case can they condition the acceptance of the service to the transfer of the vehicle to a specific workshop. The user has the right to demand that the vehicle be transported to the workshop of their choice.

I have not accepted the estimate that the crane has offered me, can the company charge me for it?

You can do it, as long as you have been previously informed of it and as long as you do not accept the budget. In any case, the amount may not exceed the amount corresponding to the number of kilometers traveled from where the tow truck is located to our vehicle.

All tow trucks are required to have official claim forms. In case of non-existence or refusal to give them to us, we can file a complaint or claim by the means we consider most appropriate.

In relation to maximum prices, there is no regulation in this regard. In this sector prices are free. However, all the information related to the service must be obtained previously in an information sheet that must be delivered to us before starting and in a written budget, which we can accept or not. Both documents must include, among other concepts, the total price broken down.
 
If you were not informed about the prices of the service before contracting or you were not given a prior estimate, you can claim.
