Those known as spam calls, in which companies try to capture the contracting of services by telephone, will no longer be a common practice, by virtue of what was approved by the new Telecommunications Law, on June 29, 2022, and that gave a period of one year for its application.

The sectors that most use this type of advertising are the telephone companies, financial institutions or insurance companies.


In this sense, the new law establishes in its Article 66 that consumers "shall have the right not to receive unwanted calls for commercial communication purposes." However, the law establishes that these calls Yes, they can be carried out when there is "a prior consent of the user himself to receive this type of commercial communications”.


Another exceptions in which these calls may be made are those contemplated by law when "the communication can rely on another basis of legitimacy than those provided for in article 6.1 of the Regulation (EU) 2016 / 679 of personal data processing”.


This exception refers to specific circumstances, such as calls necessary for the execution of a contract, for the interests of the consumer or for the fulfillment of a mission of public interest.
