The Community appears as a private accusation in the procedure against a driver who fled after a fatal collision in the capital
The Governing Council has approved today the appearance of the Community of Madrid in the legal proceedings initiated against a driver who caused a hit-and-run with death. It is the second time that a person has been involved in a traffic accident, under the new Autonomous Law on the Integrated System for Civil Protection and Emergencies, in force since last March.
The accident occurred on July 21 at number 264 Avenida de la Albufera, in the city of Madrid. The driver of the vehicle involved fled and the victim, a woman, died days later as a result of the injuries caused, including those of a cranioencephalic nature.
The regulations in force allow the regional government to go to court and appear as a private prosecution when attention to citizens through public services related to security, emergencies and Civil Protection, are produced from breaches of a criminal nature.
For this, the regional legal services have issued a favorable report that allows you to jointly exercise criminal and civil actions derived from this crime.
The preliminary proceedings of the procedure will be carried out in the Court of First Instance and Instruction number 6 of Madrid. In the process, the restitution of the costs derived from the provision of services by the Madrid 112 Security and Emergency Agency (ASEM112) will be requested.
