A commercial formula very rooted historically and with very unique characteristics.
The sector of itinerant or non-sedentary sales is one of the commercial sub-sectors to which the Community of Madrid has traditionally paid detailed attention for its special features, its economic importance and its capacity to generate employment.
Therefore, it has specific regulations on the matter, la Law 1 / 1997, of 8 of January, Regulator of the Mobile Sale of the Community of Madrid, and the Decree 17 / 1998, of 5 of February, by which the Regulation of development of the same is approved.
General Registry of Traveling Merchants
Registration is mandatory prior to requesting any municipal authorization, for the exercise of any of the following street vending modalities in the territory of the Community of Madrid:
- Sale in markets.
- Sale in popular festivities.
- Sale in isolated position.
- Traveling vehicle
Any natural or legal person exercising the street vendor and meets the following requirements:
-Alta in the corresponding tax heading of the IAE (663 group)
-Be up to date with the payment of obligations with the Public Treasury and Social Security.
-Follow the regulatory regulations of each product.
-Dispose civil liability policy.
-Put the corresponding municipal authorization.
- Registration application form.
-Copy of the NIF of the natural person, or legal representative of the legal person or, where appropriate, of the passport or community residence card, or residence and work permit for non-EU citizens (only if the interested party does not authorize consultation).
-Copy of the NIF of the legal entity.
-Copy of the corresponding discharge in the tax heading of the IAE.
-Copy of employment contracts that certify the employment relationship of the person who will develop the activity on behalf of the owner.
- Writing of constitution or social statutes (for registration of society or cooperatives).
-Examined the documentation presented together with the application, if it is incomplete, the provisional registration in the RGCA, with which you can request and obtain the corresponding municipal authorization.
- Once the municipal authorization has been obtained, the interested party will have a period of fifteen working days to present it to the RGCA of the Community of Madrid, and thus obtain the Street Vendor Card when practicing the definitive inscription in said Registry.
Street vendor card
El street vendor's license It is the document certifying the definitive registration in the General Registry of Traveling Merchants and has a validity of four years, after this period it must be renewed.
The card, which is personal and non-transferable, enables its holder to carry out the activity of street vending in any municipality of the Madrid Region within the corresponding modality and type of sale.
In addition, the owner must have the authorization whose competence corresponds to each City Council within its municipal area. These authorizations will be transferable and will have a minimum duration of fifteen years, extendable expressly for identical periods.
